Abstract
In Part I of this paper, I will illustrate the foundational aspects of American copyright law and the origins of Bleistein's aesthetic nondiscrimination doctrine. In Part II, I will explain why the term aesthetic nondiscrimination mischaracterizes the Bleistein decision and the American copyright regime.
